Terms of Service

Important: These terms require the use of arbitration on an individual basis to resolve disputes, rather than court or jury trials or class actions, and also limit the remedies available to you in the event of a dispute. Please carefully review Section 13 before you agree to these terms.

These Terms of Service ("Terms") govern your access to and use of the services provided by TravelWithMe UG ("TravelWithMe," "we," "us," or "our"), including the TravelWithMe mobile application, web application, and all related services, features, and content (collectively, the "Services"). TravelWithMe UG is a company organized under the laws of Germany, with its principal place of business at Am Zinkenschlag 19, 97450 Arnstein, Germany.

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.

1. Eligibility

By using the Services, you represent and warrant that:

  • You are at least 14 years of age. If you are under the age of majority in your jurisdiction, you have obtained the consent of a parent or legal guardian.
  • You have the legal authority to enter into these Terms on your own behalf.
  • Your use of the Services complies with all applicable laws and regulations in your jurisdiction.
  • You will not use the Services if you have previously been banned or removed from TravelWithMe.

2. Account registration

To access certain features of the Services, you must create an account. You may register using:

  • Sign in with Apple
  • Sign in with Google

By using these authentication methods, you agree to the respective terms of Apple Inc. and Google LLC. TravelWithMe does not store your Apple or Google passwords.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hey@travelwithme.app if you suspect any unauthorized use of your account.

We reserve the right to suspend or terminate your account at any time if we believe you have violated these Terms or applicable law.

3. Grant of license

Subject to your compliance with these Terms, TravelWithMe grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for personal, non-commercial purposes.

All rights not expressly granted herein are reserved by TravelWithMe.

4. License and use restrictions

You agree not to:

  • Copy, modify, adapt, or create derivative works of the Services;
  • Reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code of the Services;
  • Rent, lease, sell, sublicense, assign, or transfer your rights in the Services;
  • Use the Services for any unlawful, fraudulent, harmful, or abusive purpose;
  • Harass, threaten, or harm other users;
  • Upload or transmit viruses, malware, or other harmful code;
  • Scrape, crawl, or use automated means to access the Services without our prior written consent;
  • Impersonate any person or entity or misrepresent your identity;
  • Use the Services to send spam or unsolicited communications;
  • Interfere with or disrupt the integrity or performance of the Services;
  • Use the Services to promote illegal activities or violate the rights of third parties;
  • Collect or store personal data of other users without their consent;
  • Use the Services to advertise or sell products or services without our prior written consent.

Any violation of these restrictions may result in immediate termination of your account and access to the Services.

5. Premium subscriptions and in-app purchases

TravelWithMe offers premium features through paid subscriptions and in-app purchases, processed via RevenueCat and the respective app store platforms (Apple App Store and Google Play Store).

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period.
  • Cancellations must be managed through your Apple or Google account settings.
  • Refunds are subject to the refund policies of Apple Inc. or Google LLC, as applicable. TravelWithMe does not independently process refunds for in-app purchases.
  • Accounts terminated due to a violation of these Terms or our Community Guidelines are not eligible for a refund of any subscription fees paid.
  • TravelWithMe reserves the right to modify, discontinue, or change pricing for premium features at any time with reasonable notice.

Boost credits and other consumable in-app purchases are non-refundable and non-transferable.

6. User-generated content

By submitting, uploading, or posting content to the Services, including profile photos, trip descriptions, messages, gallery images, documents, polls, notes, and other materials ("User-Generated Content" or "UGC"), you:

  • Represent that you have the right to submit such content;
  • Grant TravelWithMe a worldwide, royalty-free, irrevocable, transferable, sublicensable license to use, store, display, reproduce, modify, and distribute your UGC in connection with operating and improving the Services;
  • Acknowledge that TravelWithMe may remove any UGC that violates these Terms or our Community Guidelines.

You must not submit UGC that:

  • Is defamatory, obscene, pornographic, threatening, harassing, or hateful;
  • Infringes any third party's intellectual property or privacy rights;
  • Contains viruses or other harmful components;
  • Promotes illegal activity;
  • Violates the rights of any other person.

You are solely responsible for your UGC. TravelWithMe does not endorse any UGC and takes no responsibility for it.

7. Third-party services and infrastructure

The Services rely on the following third-party providers. By using the Services, you acknowledge that your data may be processed by these providers in accordance with their respective privacy policies:

  • Amazon Web Services (AWS) – Cloud infrastructure, storage (S3), databases (DynamoDB), and serverless compute (Lambda) hosted in the EU (Frankfurt) region.
  • AWS AppSync – Real-time messaging infrastructure.
  • Amazon Cognito – User authentication and identity management.
  • RevenueCat – Subscription and in-app purchase management.
  • Firebase Crashlytics – Crash reporting and app stability monitoring.
  • Firebase Cloud Messaging (FCM) – Push notification delivery on Android devices.
  • Apple Push Notification Service (APNs) – Push notification delivery on iOS devices.
  • Sign in with Apple / Sign in with Google – Third-party authentication providers.

TravelWithMe is not responsible for the availability, accuracy, or practices of these third-party services. We encourage you to review their respective terms of service and privacy policies.

8. Travel meetups – disclaimer of liability

TravelWithMe is a platform designed to help users discover travel companions and coordinate trips. We do not organize, operate, or supervise in-person meetups or trips arranged through the Services.

By using TravelWithMe to connect with other users and arrange travel, you acknowledge and agree that:

  • User responsibility: You are solely responsible for your own safety and well-being during any in-person meetings or travel arranged through the Services.
  • No background checks: TravelWithMe does not conduct background checks on users and cannot verify the identity, intentions, or behavior of other users.
  • Exercise caution: We strongly recommend meeting in public places, informing trusted contacts of your plans, and following all applicable safety guidelines.
  • Assumption of risk: You participate in any meetup or travel voluntarily and at your own risk.
  • No liability: TravelWithMe, its directors, employees, and agents are not liable for any injury, loss, damage, or harm arising from in-person interactions facilitated through the Services.

9. Intellectual property

All content, design, software, trademarks, logos, and other materials comprising the Services are the exclusive property of TravelWithMe UG or its licensors and are protected by applicable intellectual property laws.

Nothing in these Terms grants you any right to use TravelWithMe's trademarks, logos, or brand assets. You may not copy, reproduce, or create derivative works of any part of the Services without our prior written consent.

10. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms or our Community Guidelines;
  • Fraudulent, abusive, or illegal activity;
  • Extended periods of account inactivity;
  • Legal requirements or regulatory obligations.

Upon termination, your license to use the Services will immediately cease. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

11. Disclaimer of warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION.

TRAVELWITHME DOES NOT WARRANT THAT:

  • THE SERVICES WILL BE AVAILABLE AT ALL TIMES OR FREE FROM ERRORS, BUGS, OR VIRUSES;
  • ANY INFORMATION PROVIDED THROUGH THE SERVICES IS ACCURATE, COMPLETE, OR CURRENT;
  • THE SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS.

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRAVELWITHME UG AND ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

IN NO EVENT SHALL TRAVELWITHME'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TRAVELWITHME IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) €100 EUR.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE GERMAN OR EU LAW.

13. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

For users in the European Union: You may also have the right to submit a complaint to your local data protection authority or use the EU Online Dispute Resolution platform available at https://ec.europa.eu/consumers/odr.

Any disputes arising out of or relating to these Terms or the Services that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts located in Germany.

14. Modifications to these terms

TravelWithMe reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the app or by email. Your continued use of the Services after any modification constitutes your acceptance of the revised Terms.

If you do not agree to the modified Terms, you must stop using the Services.
